1. Introduction
1.1 These terms & conditions apply between you (‘the guest’), and us, Brisley Hall Farm (‘the owner’) of Brisley Hall Farm CL at Big Sky, Hall Farm, Church St, Brisley NR20 5AA (‘the site’). Please read this document carefully, as it affects your legal rights. If anything is unclear, please contact us so we can explain in further detail to avoid misunderstandings.
2. Bookings are subject to the following terms & conditions:
2.1 A contract between you and the owner comes into existence when a full payment or a deposit is received and a booking confirmation has been issued, showing the confirmed holiday dates – whether automatically online or manually. It is your responsibility to ensure all members of your party accept the terms of the contract set out in these terms & conditions. Failure to disclose relevant information or to comply with these terms may lead to termination of the contract and loss of the booking.
2.2 We strongly advise that you take out travel insurance to cover the possibility of a cancellation. If you choose not to, then you accept responsibility for any losses you may incur.
2.3 In the unlikely event of a double-booking or pitches becoming unavailable for any other reason, we reserve the right to offer the guest alternative dates or a full refund, limited to the return of payments made to us.
2.4 We may cancel bookings if the pitches become unavailable for reasons beyond our reasonable control, including, but not limited to, flooding, fire, significant damage, failure of utility services and weather damage. In this event we will refund in full any payments already made for your stay. Our liability for cancellation will be limited to the return of payments already made to us.
2.5 The CL Site closes for the winter from 1st November to no later than 1st April.
2.6 We expect guests to treat our property and our site with the same respect that they would their own homes and property.
2.7 The property is a working farm and from time to time there may be noise from and movement of machinery or animals
2.8 5 mph maximum speed anywhere on the owner’s property must be adhered to at all times
2.9 Permission must be requested from the owner to use a drone or other radio-controlled devices on the site.
2.10 The owner will not be held responsible for any loss or damage, however, caused, to the property or vehicles of any guest or their visitors nor any injury to any guest or their visitors whilst staying on the CL or anywhere on the site.
2.11 Payments accepted are BACs transfer, cash or cheque
2.12 If visitors leave reviews, testimonials and general comments about their stay on customer reviews websites and apps, it should be understood that these comments may be used on our own website and/or in our social media marketing, unless the guest specifically requests that we do not do so.
2.13 We reserve the right to make reasonable amendments or additions to these terms & conditions without notice.
3. Deposit and balance payments
3.1 Rates are from £26/night (2024) for a standard sized unit including VAT and an awning of porch or standard size OR a pup tent, not both. Dog runs by prior permission only. Additional nightly charges apply for dogs (£2 each, maximum 2), extra adult (£4) and extra vehicle (£2). For weekly bookings the 7th night is half price. A small supplement is charged for bookings of less than 4 nights over a Bank Holiday weekend and the owner reserves the right to amend the pricing structure and rates as required.
3.2 A supplementary £5 is charged for single night stays, if accepted by the owner.
3.3 The booking, and subsequent stay, must be made by a paid-up member of the Caravan and Motorhome Club
3.4 Deposit – a deposit of 50% of the total cost of your stay, up to a maximum of £55 per week. The booking is not confirmed until the deposit has been received. The deposit is refundable less a small admin fee, or transferable to a stay in the same year, if you cancel or adjust the dates of your booking up to one month before the arrival date (or within the month before for evidenced medical reasons ).
3.5 Balance due – Your final payment should be made on arrival either by BACs, cash or cheque.
3.6 We reserve the right to decline a booking for any reason
4. Check-in/out
4.1 Check-in: Pitches are available for occupation from 1.00pm
4.2 Members must report to the site owner before pitching
4.3 Members must pitch where directed by the owner and must show their membership cards if requested to do so.
4.4 Check-out: Pitches must be vacated by 12 noon on the day following the last night of the booking.
4.5 The owner will do their best, where possible, to accommodate earlier arrivals or later departures
5. Occupancy and general rules
5.1 No-one other than the person named on the booking and their guest(s) may stay on the site
5.2 Any extra guests or visitors not notified at the time of booking must be AUTHORIZED by the owner before arriving on the site.
5.3 Members and their guests must obey all instructions given by the owner
5.4 Extra cars must be parked in the designated parking spaces, ensuring vehicles do not block access for others or compromise safety on the site
5.5 The main gate must be shut securely behind you at all times if it is shut on approach.
5.6 Ground sheets are NOT allowed to maintain the grass pitch at it’s optimum for everyone. (Grass clippings are collected)
5.7 No gas cylinders with a capacity greater than 15 kg to be used & no gas cylinders of any size to be disposed of in the waste bins.
5.8 No campfires
5.9 No generators unless permission has been sought from the site owner prior to arrival.
5.10 A maximum of 2 dogs per pitch are allowed and are to be kept on a lead of no longer than 2 meters AT ALL TIMES on site and on the owner’s property. Dogs to be walked on the various tracks adjoining the site and NOT on the site itself and please clear up after them. The site does not accept REACTIVE dogs or any of the breeds/crossbreeds listed in the Dangerous Dogs Act (i.e. XL Bully, Pit Bull Terrier, Japanese Tosa, Dogo Argentino, and Fila Brasileiro) and/or any of the following: Staffordshire bull terrier, American Staffordshire terrier, Rottweiler, any Mastiff or Tosa.
5.11 No awning heating or air conditioners allowed.
5.12 No unauthorized visitors, parties or events allowed either on site or on the owner’s property.
5.13 Bikes can be stored under cover or in locked premises upon arrangement with the owner
5.14 BBQ’s must be off the ground and not scorch the grass, and are not allowed when weather conditions are deemed unfavourable by the owner – please refer to the site Notice Board if in doubt.
5.15 Noise must be kept to a reasonable level, as decided by the owner, at all times . No noise or vehicle movement between 10.00 pm and 7 am without prior notification.
5.16 No smoking or vaping in or anywhere near the barn nor to the detriment of the occupants of other pitches. Cigarette-ends, etc., must be disposed of safely into the appropriate waste bin.
5.17 Rubbish, waste water and chemical waste must be disposed of neatly in the appropriate and named receptacles. Pitches must be cleared of all property and refuse on vacation.
5.18 Members have full access to the site’s Permissive footpaths on and around the site, but access to working farmland is forbidden
5.19 The owner reserves the right to refuse acceptance or to terminate the visit of any person whose behaviour, or the behaviour of their pet(s), is detrimental to them or to other visitors and to report the member to the Caravan and Motorhome Club.
5.20 WiFi/internet is not currently connected to the site as 4G signal is deemed excellent.
5.21 The owner shall not be liable for defects or malfunctions of any facilities, equipment, or appliances.
5.22 No compensation will be given for any outages of electricity, water, internet connection or television/radio signal.
6. Cancellation & Amendments
6.1 Cancellation by the guest must be notified in writing to the owner. If notification is received by the owner within one month of your arrival date due to genuine and proven medical reasons the booking deposit is refundable less an administration charge.
6.2 Any amendment requests for your stay must be notified in writing to the owner at least one month before your arrival date. If the amendment can be accommodated an administration fee may be charged and cancellation charges as in 6.1 above will be charged if relevant.
6.3 Once dates of booking have been confirmed in writing (including email) they can only be changed with our written agreement. Such change may incur an administration charge.
6.4 We cannot offer refunds if guests are unable or unwilling to complete their stay. Early departure will not reduce the price of your rental.
6.5 We reserve the right to terminate a guest’s stay without compensation where we deem that the unreasonable behaviour of the persons named on the booking or their guest(s) or their pets may impair the enjoyment, comfort or welfare of others or that Terms and Conditions are being violated
7. Damages and breakages
7.1 Please treat our facilities with due care so that other guests may continue to enjoy them. It is a condition of your stay that you keep the pitch clean and in good order.
7.2 If damage or breakages occur during your stay, we would be grateful if you could report them promptly – before or on checking-out. The pitches will be inspected at the end of your stay and you will be charged for any losses and/or damages.
7.3 If on arrival you notice something is missing or damaged on your pitch, please let us know straight away so we can take appropriate action.
7.4 Breakages, damages, theft and other problems, together with any extra cleaning required if the property is left dirty, will be charged to you.
7.5 We or our representatives reserve the right to enter a pitch at any time to undertake essential maintenance or for inspection purposes.
7.6 We cannot be held responsible for the loss of any personal belongings or valuables of guests on the CL Site or anywhere on our property.
7.7 Any problem or complaint that guests may have concerning their stay must be reported immediately to the owner and we will endeavour to put matters right. Any complaint not reported to us at the time and only reported after the guest has departed at the end of their stay will not be considered.
8. Breach of contract
8.1 If we have reasonable concerns that the guest or any member of the guest’s party may be breaching these terms & conditions, then the owner or their representatives have the right to visit a pitch and inspect the property at any time.
8.2 If you commit a serious breach of these terms & conditions we have the right to terminate your booking. If you are already on a pitch, then we may require you to leave the site immediately.
9. Force majeure
9.1 We cannot accept liability or responsibility for any alterations, delay or cancellation or any other loss or damage caused by war, civil strife, terrorist action, industrial dispute, fire, sickness, bad weather, livestock, epidemic, act of any government or public authority, or changes imposed by re-scheduling of airlines, ferries, or any other event outside of our control.
10. Covid-19, illness and epidemics
10.1 Firstly, and above all else, we urge ALL guests to buy appropriate travel insurance. We are not permitted to recommend individual insurers.
10.2 Guests should follow Government guidance on dealing with suspected or confirmed coronavirus or any other epidemic infections .
10.3 In the event of a national lockdown or if we are required to close the site by the Government we will offer you a transfer of dates (priced accordingly) or a full refund.
10.4 We cannot offer refunds simply because you become disinclined to travel. So if you change your mind and choose not to use your booking, then we will not offer a refund. Please refer to the section entitled Cancellation above.
10.5 We cannot offer refunds for illness, including Covid-19, personal shielding or self-isolation. This means that you must claim on your own insurance. If you do not have insurance, please refer to the section entitled Cancellation above.
10.6 If a guest becomes unwell during their stay, the owner or their representative will do everything they can to help but further professional help must be sought as necessary. A guest who cannot travel will be liable for any additional pitch fees for any longer period of stay, as well as any costs incurred in cancellations.
Finally, a polite request – Please will you kindly report any issues to the owner or their representative, either in person or other means, giving appropriate time for a response, rather than taking them directly to a public review. Many thanks
